International Fund for Elephant Conservation

一、基金的设立

1. Establishment of the Fund

第一条 为积极参与大象保护国际合作，表明我国支持国际大象保护的实际行动，也为了促进我国传统牙雕工艺和文化的传承与发展，中国野生动物保护协会决定设立“国际大象保护基金”（以下称本基金）。

Article 1 In order to participate actively in the international collaboration of elephant conservation, to demonstrate the actual actions of national support of China to international elephant conservation, and to promote the heritance and development of traditional ivory carving craftwork and culture of China, China Wildlife Conservation Association decides to set up International Fund for Elephant Conservation.(hereafter the Fund).

第二条“本基金”是由象牙加工业者、大象保护工作者、动物保护组织等自愿捐助设立、用于支持国际大象保护、野外种群资源监测、CITES象牙非法贸易监测等小额项目的基金。

Article 2 The Fund is established based on volunteer donation from ivory processor, elephant protector and animal protection organizations, which is used for funding small-sum projects of international elephant conservation, monitoring of Field population resources and monitoring of CITES illegal ivory trade.

第三条 “本基金” 在中国野生动物保护协会账簿中设专门科目核算，专款专用。其募集和使用接受国家林业局、国家濒管办的监管。

Article 3 Special account for this Fund will be established in the account book of China Wildlife Conservation Association. This Fund shall be specialized for special purpose. Collection and usage of the Fund shall be supervised and administrated by State Forestry Administration and CITES of P.R.CHINA.

第四条 “本基金”由中国野生动物保护协会直接管理，不设分支机构。

Article 4 The Fund is administrated directly by China Wildlife Conservation Association, and no branch office is set up.

第五条 “本基金”成立基金管理专家组，负责基金募集、确定资助方向并公示、评议并确定资助项目、基金拨付、项目实施情况检查等项工作。基金管理专家组吸收国家林业局保护司、国家濒管办的相关人员组成。专家组工作会议可邀请主要捐助者代表参会。

Article 5 Experts group is arranged for fund management, which is responsible to collect funds, determine and publicize the fields of funding, evaluate and determine the projects to be funded, appropriate fund and supervise project execution. Experts group is set up by recruiting relevant representatives from Wildlife Conservation Department of State Forestry Administration and CITES of P.R.CHINA. Main donator representatives can be invited to the working conference of experts group.

第六条 “本基金”经中国野生动物保护协会常务理事会通过后开始运作。

Article 6 The Fund shall be initiated and operated after passing by executive board meeting of China Wildlife Conservation Association.

二、 基金的筹集

2. Fundraising

第七条 中国野生动物保护协会面向海内外向支持国际大象保护的团体（重点是国内象牙加工单位）、人士募捐，筹集“本基金”。所有捐款包括指定用于工作管理经费的捐助全部进入该项基金。

Article 7 China Wildlife Conservation Association tries to collect nationally and internationally donation from individuals and groups (especially domestic ivory processing units) that support international elephant conservation. All donation including funds specified for administrative management is saved in this Fund.

第八条筹集“本基金”必须遵循合法、自愿的原则，杜绝摊派。

Article 8 fundraising shall comply with the principle of legitimacy and voluntary. Apportion is forbidden.

第九条为体现我国象牙传统工艺行业对国际大象保护的支持，“本基金”接受象牙工艺行业从业单位及热心此行业人士的捐助。

Article 9 In order to demonstrate the support of Chinese traditional technique industry to international elephant conservation, the Fund accepts donation from units that engage in ivory carving craftwork business and personages who enthuse about ivory carving craftwork business.

第十条所有向“本基金”的捐款，均需履行捐赠手续，由中国野生动物保护协会开具收据，颁发捐助证书。数额较大的捐赠，捐受双方可签署《捐赠协议书》，明确捐助方的权力义务。

Article 10 Donation procedures shall be performed for all donations to the Fund. Receipt shall be issued and certificate of donation shall be awarded by China Wildlife Conservation Association. For relatively large sum of donation, both parties of donator and acceptor can sign a donation agreement, which specifies the rights and obligations for both parties.

第十一条单笔向“本基金”捐款超过30万元以上的捐助人，可在其所资助的国际大象保护项目冠名，并在中国野生动物保护协会网站公示。

Article 11 Any individual whose single donation to the Fund is above300,000RMB can name the elephant conservation project and publicize in the website of China Wildlife Conservation Association.

第十二条中国野生动物保护协会秘书处每年向常务理事会和基金管理专家组成员及捐助人报告“本基金”的募集及使用情况。

Article 12 The secretariat of China Wildlife Conservation Association shall report the situation of fund collection and fund utilization to the donators as well as the members of the Fund management experts group and the executive board every year.

第十三条按照国际惯例，中国野生动物保护协会按照“本基金”总额的10%提取项目管理费，用于相关项目管理支出。

Article 13 In accordance with international conventions, 10% of the total sum of the Fund shall be reserved by China Wildlife Conservation Association for project management, which shall be used for administration of relevant projects.

三、 基金的管理和使用

3. Management and Utilization of the Fund

第十四条 “本基金”提取项目管理费后，将全部用于资助与国际大象保护相关的小额项目，专款专用。

Article 14 After the fee for project management is reserved, the rest of the fund shall be all funded to the small-sum funding project relevant to international elephant conservation. The Fund shall be used only for elephant conservation.

第十五条基金管理专家组根据每年基金募集情况，于每年年底前定期公布下一年度小额项目的申报指南，明确资助方向和规模、申报要求等，并在网站公示。网址：www.cwca.org.cn。

Article 15 Experts group of Fund management shall issue the application guide of small-sum funding for next year in the end of every calendar year based on the situation of Fund collection. The field, scale and requirement of application shall be defined definitely in the application guide and publicized in the website: www.cwca.org.cn.

第十六条小额项目的申请人可以是法人或自然人。申请人通过网站下载申请指南和提交申请。

Article 16 Applicant of small-sum funding project can either be a corporate representative or natural person. The applicant can download the application guide and submit application via the website mentioned above.

第十七条 对有明确使用意愿的捐赠，应尊重捐赠者的要求，但原则上不得超出国际大象保护行动的实施范围。

Article 17 For donation with definite purpose, donator’s requirement shall be respected, but in principle, it can not be above the scope of application of international elephant conservation.

第十八条基金管理专家组根据对申请人提交的项目申请公开进行评审。根据申请人的执行能力、项目实施方案的科学性和可行性、项目预算的合理性等因素，最终确定所资助的小额项目。在网站公布评审结果并通知申请人。

Article 18 Experts group of Fund management shall evaluate the applicant’s application publicly. Projects of small-sum funding shall be determined finally based on applicant’s ability of execution, scientificity and feasibility of project’s execution plan and reasonability of project budget. Results of evaluation shall be publicized in the website and informed to the applicant.

第十九条中国野生动物保护协会根据获资助项目的进度要求拨付款项。

Article 19 China Wildlife Conservation Association shall appropriate the funds according to schedule of the project to be funded.

第二十条申请人需按时完成项目，并向中国野生动物保护协会提交结题报告。对两次不能按时完成项目的，将取消其今后申请该项目的资格。

Article 20 The applicant must finish the project on time and submit final report to China Wildlife Conservation Association. For applicant who fails to finish the project twice, qualification for applying this Fund shall be cancelled in the future.

第二十一条 基金管理专家组将对项目结题报告进行审查验收。验收不合格的，暂停申请人申请资格。必要时，可前往项目实施地核查实施效果。

Article 21 Experts group of Fund management shall examine and review the final report of the project funded. In case the final report failed to pass the review and examination, applicant’s qualification for application of this Fund will be suspended for the time being. When necessary, effectiveness of project execution shall be examined on site.

本制度自发布之日起实施。本制度解释权归中国野生动物保护协会。The system shall be put into practice at the date when it is issued. China Wildlife Conservation Association reserves the right to explain this system.

Management System on

International Fund for Elephant Conservation

Collection and usage of the Fund shall be supervised and administrated by State Forestry Administration and CITES of P.R.CHINA.

Experts group is set up by recruiting relevant representatives from Wildlife Conservation Department of State Forestry Administration and CITES of P.R.CHINA. Main donator representatives can be invited to the working conference of experts group.

Article 12 The secretariat of China Wildlife Conservation Association shall report the situation of fund collection and fund utilization to the donators as well as the members of the Fund management experts group and the executive board every year.

Article 13 In accordance with international conventions, 10% of the total sum of the Fund shall be reserved by China Wildlife Conservation Association for project management, which shall be used for administration of relevant projects.
